Service Terms For Clear, Professional Booking Agreements.

Effective date: March 9, 2026. These terms apply to all services unless your signed agreement includes custom terms in writing.

Signed Booking Required

Dates are only secured after the agreement is signed and the required retainer is received.

Final galleries and licensed deliverables are not released while invoices remain unpaid.

Clients receive usage rights based on package terms. Full copyright transfer requires a separate written agreement.

Limits And Protections

Coverage depends on real event conditions, and liability is limited as described in the service terms.

Scope Of Services

Services include photography coverage, creative direction, editing, and final delivery based on selected package scope.

Special requests, expanded coverage, custom edits, or non-standard deliverables must be approved and documented before service date.

Quoted pricing only covers the deliverables, hours, and production assumptions listed in the invoice or agreement. Additional locations, extended timelines, complex coordination, or same-day changes may require a revised invoice.

Booking Confirmation + Retainer

A signed agreement and required retainer are necessary to reserve date and time. Dates are not guaranteed until booking is complete.

Retainers are non-refundable and compensate for reserved production time and calendar hold.

If the client does not complete required booking steps by the stated deadline, Deacon's Photography may release the date to another client without further obligation.

Payment Terms

Balances are due according to invoice schedule. Late balances may pause editing, delivery, and final handoff.

Returned, disputed, or failed payments may include applicable administrative or processing fees.

No final gallery, download release, or licensed deliverable is required to be delivered while a balance remains unpaid. Partial payment does not create partial ownership of unfinished files or unlicensed content.

Reschedules + Cancellations

Date changes should be requested at least 30 days before the original session date. Changes with less than 30 days notice may require added rescheduling fees.

Reschedule requests are subject to availability and season demand. Cancellations forfeit non-refundable retainers.

Client no-show or significant delay may reduce coverage window without price reduction.

Where a client materially changes the event schedule, location, or production scope close to the service date, Deacon's Photography may require additional fees or may decline the revised scope if it is not operationally feasible.

Travel + Location Responsibilities

Included travel and additional mileage are defined in Pricing/Packages. Extra travel-related costs may apply when relevant.

Client is responsible for permits, venue permissions, parking, tolls, and location access requirements unless otherwise agreed.

Deacon's Photography is not responsible for missed images caused by venue restrictions, photography bans, poor lighting rules imposed by the venue, late access, or denied movement within the event space.

Creative Control + Editing Standards

Deacon's Photography maintains creative discretion over style, curation, composition, and final image selection.

Raw files are not included unless explicitly purchased. Final edits represent brand quality standards.

Examples shared during inquiry or on the website are illustrative and do not guarantee exact duplication of lighting, weather, poses, venue conditions, subject cooperation, or third-party styling on any future session.

Delivery + Gallery Access

Delivery timelines vary by package, season, and project scope. Estimated turnaround is provided during booking.

Galleries remain active for a limited period unless extension is purchased. Clients are responsible for downloading and backing up files.

Once delivered, the client must review the gallery promptly and report any access issue, missing file issue, or obvious delivery concern within a reasonable period so corrective action can be documented.

Usage Rights + Licensing

Deacon's Photography retains copyright to created media unless written copyright transfer is executed.

Personal-use rights are provided as listed in package terms. Commercial, advertising, publication, resale, or third-party use requires licensing approval.

Clients may not alter delivered images in a way that removes the creator’s quality standards, misrepresents the work, or creates a false association with unapproved branding, endorsements, or paid campaigns without permission.

Model Release + Promotional Use

Unless restricted by written agreement, Deacon's Photography may use selected delivered images for portfolio, website, social media, and promotional examples of work. Clients requesting confidentiality or non-promotion should raise that request before booking.

Commercial clients may receive custom usage and publicity terms in their signed agreement where campaign confidentiality, launch dates, or brand restrictions apply.

Client Conduct + Safety

Clients and participants must maintain safe, respectful conditions for all personnel and equipment.

Unsafe or abusive conduct may result in immediate termination of services without refund.

Liability + Force Majeure

Liability is limited to amounts paid under the applicable service agreement except where prohibited by law.

We are not responsible for delays or non-performance caused by events outside reasonable control, including severe weather, emergencies, or service outages.

This limitation also applies to indirect, incidental, special, or consequential damages related to schedule disruption, venue changes, weather impact, device incompatibility, or third-party service failures, to the extent permitted by law.

Substitution + Coverage Limits

If illness, emergency, or other serious issue prevents direct coverage by Deacon's Photography, reasonable efforts may be made to provide a qualified substitute photographer, adjusted service arrangement, or reschedule option depending on circumstances.

Shot lists, requested family groups, and key coverage priorities are taken seriously, but no session can guarantee every conceivable image where timing, cooperation, weather, venue restrictions, or event conditions make capture impossible.

Disputes + Governing Law

Both parties agree to attempt good-faith resolution in writing before escalation.

These terms are governed by applicable laws of Pennsylvania, United States, unless written contract terms specify otherwise.
